How does this hit not award a penalty and/or suspension? How is one blow to the head more legal than the next? Oh wait, I know Tootoo is a somebody and Steve Downie and Bouelrice are nobodies. Now, both Flyers players received the proper suspensions (if the NHL continues their new policy with everyone -- which it seems they are not.) The NHL only wants to make examples of young kid in Downie and a nobody like Boulerice.
On a side note, Holmgren has stated that Boulerice received what he deserved, calling his play "careless" and "senseless."
The NHL is still a joke.

I think Tootoo did lower his shoulder to make a hit and the elbow was just a reaction of contact. Tootoo had no means in intentionally hurting the other skater even though he should have gotten a 2 minute minor for roughing.
Tootoo has been known as one of the dirtiest players in hockey. It was charging.
